Terms of Service

1. Acceptance

By downloading, installing, or using Noir Files (the "App"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the App.

2. Eligibility

You must be at least 13 years old (16 in the EEA/UK where required) to use the App. By using it you represent that you meet this requirement and have the legal capacity to enter into these Terms. If you are a minor, you confirm that your parent or legal guardian has reviewed and accepted these Terms on your behalf.

3. Your Account

You are responsible for keeping your credentials confidential and for all activity under your account. You may not share, sell, rent, or transfer your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms (see section 10).

4. Credits, Rewards & Purchases

• Credits are an in-app virtual item used to generate cases and unlock clues. They have no monetary value and cannot be redeemed for cash, exchanged, transferred, or inherited.
• Credits may be earned (e.g. by watching rewarded ads) or purchased through Google Play Billing where available.
• All purchases are processed by Google Play and governed by Google's payment terms.
• Unused credits expire 24 months after issuance or upon account termination, whichever is earlier.
• We may adjust credit costs and reward rates at any time.

5. Refund Policy

All in-app purchases are final and non-refundable once credits are delivered to your account, except where required by applicable law or Google Play's refund policy. Refund requests must be submitted through Google Play within 48 hours of purchase. We do not process refunds directly; please use Google Play's refund process.

6. Advertisements

The App displays ads (including banner, interstitial, app-open, and rewarded ads) through Google AdMob. Rewarded ads grant in-game credits on successful completion. Tampering with, spoofing, or automating ad views is prohibited and will result in forfeiture of rewards and possible account termination. See our Privacy Policy for advertising data practices.

7. AI-Generated Content

Mystery cases, clues, suspects, and images are generated by third-party AI models for entertainment only. All characters, events, and scenarios are fictional; any resemblance to real persons, places, or events is coincidental and unintentional.

You agree not to submit prompts that are illegal, defamatory, sexually explicit, hateful, harassing, that depict minors in unsafe contexts, or that target real, identifiable individuals. We may block, remove, or report content that violates these Terms or applicable law.

8. Intellectual Property

The App, its branding, code, art, sound, and original assets are owned by Noir Files and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial entertainment.

AI-generated outputs created from your prompts are licensed to you for personal use only. You may not resell or commercially redistribute AI outputs. You are responsible for your prompts and warrant that they do not infringe third-party rights.

9. Prohibited Conduct

• Cheating, exploiting bugs, manipulating leaderboards, or tampering with ad rewards.
• Harassing, threatening, or impersonating other players in multiplayer rooms.
• Reverse-engineering, decompiling, scraping, or abusing our APIs.
• Using bots, emulators, modified clients, or automation tools.
• Uploading malware, infringing content, or violating any law.

10. Suspension & Termination

We may, at our sole discretion, suspend or terminate your account, remove content, or restrict features if you breach these Terms or applicable law, or if your conduct risks harm to other users or to us. Upon termination, your license to use the App ends immediately and unused credits are forfeited. You may stop using and uninstall the App and delete your account at any time (see Privacy Policy § 9).

11. Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that AI outputs will be accurate or appropriate.

12. Limitation of Liability

To the maximum extent permitted by law, Noir Files and its affiliates are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or credits, arising from or related to your use of the App. Our total aggregate liability for any claim shall not exceed the greater of (a) the amount you paid us in the 6 months before the claim, or (b) USD 25.

13. Indemnification

You agree to indemnify and hold harmless Noir Files, its affiliates, and personnel from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the App, your content/prompts, or your violation of these Terms or applicable law.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of India, without regard to its conflict of laws principles. Any dispute shall first be attempted to be resolved amicably by writing to support@noirfiles.xyz. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the competent courts located in India.

15. Third-Party Services & Stores

The App is distributed via Google Play Store and uses third-party services (Google AdMob, Supabase, Cloudflare, AI providers). Your use of those services is also governed by their respective terms and privacy policies. If a conflict arises between these Terms and Google Play's Developer Distribution Agreement, the latter controls for distribution matters.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified in-app or via email at least 7 days in advance. Continued use after the effective date constitutes acceptance of the updated Terms.

17. Severability & Entire Agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. These Terms and the Privacy Policy constitute the entire agreement between you and Noir Files regarding the App.
